Rocky Mountain EMTEC, Inc. engineers understand the litigation process, and in addition to providing credible expert opinions, work with clients to develop effective technical strategies, often providing litigation support as non-testifying experts.  Such support may include assistance in preparing discovery requests, deposing fact and expert witnesses, witness preparation, investigative services, and trial support.  We serve defendants and plaintiffs without preference or bias, and offer opinions based on the merits of the individual cases.

Failure Analysis

Our experience in failure analysis includes consumer products, automotive components, heavy equipment and parts, process and facility constituents, medical devices and tools, and a wide range of other items.  We serve the plaintiff's bar and the defendant's bar, and have served as impartial experts for the court and for mediators.  Insurance companies, outside claims investigators, and subrogation agents use EMTEC's engineering services to make informed claims decisions.

The EMTEC engineers often use techniques of safety management and engineering to evaluate products, processes, and premises for both plaintiff's and defendant's cases.  These techniques bridge the gap between good engineering practice and legal duty, and provide unassailable and effective litigation techniques.

EMTEC has specific expertise in premises accident investigation and analysis, including slip/trip/fall incidents and other personal injury matters.  The EMTEC engineers use many of the same techniques of safety management and engineering that are applied to product failures to evaluate the circumstances surrounding a premises incident, and relate the occurrence of the incident to the behavior, policies, and practices of those responsible for the premises.

While EMTEC does not do Vehicle Accident Reconstruction per se, we do often analyze vehicle component failures and their effects, and characterize vehicle damage.  When reconstruction is necessary, we work closely with those experts to provide clients with the best combination of teamwork and talent to present their cases.

Industrial accidents are also an EMTEC focus area.  The engineers at EMTEC are skilled at determining the causative and contributory factors related to industrial accidents.

Rocky Mountain EMTEC, Inc. engineers have experience evaluating claims regarding intellectual property and patents.  This experience ranges from evaluation of infringement claims to assessments of proposed technologies, designs, and concepts relative to the state-of-the-art at the time of the claim.  Rocky Mountain EMTEC, Inc. engineers have been retained by courts as independent experts in evaluating competing intellectual property claims, as well as by plaintiff and defense counsel in various matters involving patent claims or intellectual property matters.
